It's just about being a respomsible landloard. A simple background check on the renters is all you have to do. It's not rocket science.
Yes but, could not renting to someone because of thier background be construed as discrimination?
I haven't been able to view the actual new nuisance law. But it appears to conflict with Wisconsin's fair housing laws, if what they have been saying is true. There are some exceptions. A landlord can refuse to provide housing to an individual whose tenancy would constitute a direct threat to other tenants or the community. The landlord can also demand information regarding family, marital, financial and business status, but not concerning race, disability, sexual orientation, ancestry or religion. But this is before you accept the tenants. Once they're in, it becomes more difficult.
The idea that the police chief can use this law as he see's fit(discretion) is another problem. (Favoritism?)Laws should be enforced without discretion by the officers. A judge or hearing committee should decide on whether the complaint has merit. The language in this ordinance sounds weak and that is without reading it yet.
